1. 15-31, In Re: Lynne Hoban, D.V.M. 

Attorney David Stoll, on behalf of Respondent, was present to monitor. Complainant Mr. 
Abrams was present and made statemenis. After discussion and consideration, a motion 
was made by Ms. Young and seconded by Dr. Haifield to schedule this matter for an 
nformal Interview. Motion passed unanimously. 


2. 15-32, In Re: Emily Clinton, D.V.M. 

After discussion and consideration, a motion was made by Dr. Wright and seconded by Ms. 
Mumford to accept the Investigative Committee’s recommendation and dismiss this matter 
with no violation. Motion passed unanimously. ; 


3. 15-35, In Re: Walter Kurth, D.V.M. 

After discussion and consideration, a motion was made by Dr. Hatfield and seconded by 
Mr. Loughead to schedule this matter for an Informal interview. Motion passed 5 ayes, | 
absent {Dr. Wright).

4, 15-36, In Re: Carly Blom, D.V.M. 

Attorney David Stoll, on behalf of Respondent, was present to monitor. Complainant Mr. 
McMasters was present and made statements. After discussion and consideration, a motion 
was made by Dr. Wright and seconded by Mr. Loughead to accept the Investigative 
Committee's recommendation and dismiss this matter with no violation. Motion passed 
unanimously. 


5. 15-37, In Re: Perpetual Pets, LLC 

After discussion and consideration, a motion was made by Mr, Loughead and seconded by 
Ms. Mumford to accept the Investigative Committee's recommendation and dismiss this 
matter with no violation. Motion passed, 5 ayes, 1 absent (Dr. Wright). 


Ill, INFORMAL INTERVIEWS AND BOARD DELIBERATION 


1. 15-25: In Re: Eric Roberts, D.V.M. Continuance of Informal Interview of March 18, 2015, for 
the purpose of receiving additional Information, reviewing, and possible action to approve 
proposed Findings of Fact, Conclusions of Law and adopting an Order, 

Dr. Christensen recused. After discussion and consideration, a motion was made by Dr. 
Hatfield and seconded by Ms. Mumford to accept the Findings of Fact and Conclusions of 
Law as written. Motion passed 5 ayes, 1 recusal (Dr. Christensen). 


After discussion and consideration, a motion was made by Dr. Hatfield and seconded by 
Ms. Mumford to issue Dr. Robert's an Order requiring him to pay a $500 civil penalty to be 
paid within 90 days of the effective date of the Order: 
© $300 civil penalty for A.R.S. § 32-2232 (18) as it relates to A.A.C. R3-11-901 (B) for 
failure to resoond to a complaint in a timely fashion; 
e¢ $100 civil penalty for A.R.S. § 32-2232 (21) as it relates to A.A.C. R3-11-502 (L) (10) 
failure for each individual to initial entries made in the medical record; and 
e $100 civil penalty for A.R.S. § 32-2232 (21} as it relates to A.A.C. R3-11-502 (M) (1-5) 
failure to maintain radiographs on the premises for three years. 
Roll call: Mr. Loughead, aye; Dr. Christensen, recused; Ms. Young, aye; Dr. Hatfield, aye; Ms. 
Mumford, aye; and Dr. Wright, aye. Motion passed 5 ayes, ] recusal (Dr. Christensen). 


2. 15-13: In Re: Kimberlei Hurst, D.V.M. Continuance of informal Interview of March 18, 2015, 
for the purpose of receiving additional information, and reviewing, and possible action to 
approve proposed Findings of Fact, Conclusions of Law and adopting an Order. 

Mr. Loughead recused. After discussion and consideration, a motion was made by Ms. 
Mumford and seconded by Dr. Hatfield fo approve the Findings of Fact and Conclusions of 
Law as written. Motion passed 5 ayes, 1 recusal (Mr. Loughead). 


At 9:50a.m., a motion was made by Ms. Mumford and seconded by Dr. Hatfield to go into 
executive session for legal advice. Motion passed 5 ayes, | recusal (Mr. Loughead). 


At 10:02a.m., the Board entered back into open session. 


After further discussion and consideration, a motion was made by Ms. Mumford and 
seconded by Dr. Hatfield to issue Dr. Hurst an Order to include a period of Probation of one 
__(!) year for violation A. RS. § 32-2232 (7) for chronic inebriety or unlawful use_of narcotics,

dangerous drugs or controlled substances in April and May of 2014. The following will be 
required per the Order: 

e Quarterly reports from Dr. Hurst's ongoing and/or new behavioral health care 

provider; 

e Quarterly, in person, Board meeting visits from Dr. Hurst; and 

e Quarterly Pharmacy Board reports that will be obtained by Board staff. 
Additionally, Dr. Hurst shail pay a $500 civil penalty for violation A.R.S. § 32-2232 (18) as it 
relates to A.R.S. § 32-2271 (A) for providing veterinary medical services to the public for 
approximately six {6) weeks without a premise license issued by the Board or submitting a 
complete application, with payment, to the Board. Civil Penalty is due pursuant to the 
terms of the Order. 


Roll call: Mr. Loughead, recused; Dr. Christensen, aye; Ms. Young, aye; Dr, Hatfield, aye; Ms. 
Mumford, aye; and Dr. Wright, aye. Motion passed 5 ayes, 1 recusal (Mr. Loughead). 


IV. ADMINISTRATIVE REVIEW OF PREVIOUS ACTIONS 


1, 15-10: In Re: Refaat Ishak, D.V.M. Board may review, discuss, and take action on motion 
for rehearing or review, 
Attorney David Stoll on behalf of Respondent was present to monitor. 


At 9:40a.m., a motion was made by Ms. Mumford and seconded by Dr. Haifield to go into 
executive session for legal advice. Motion passed unanimously. 


At 9:46a.m., the Board entered back into open session. 


After discussion and consideration of the arguments made in Respondent's Motion, a 
motion was made by Dr. Hatfield and seconded by Ms. Mumford to deny Respondent's 
Motion for Rehearing or Review. Roll call: Mr. Loughead, aye; Dr. Christensen, aye; Ms. 
Young, aye; Dr. Hatfield, aye; Ms. Mumford, aye; and Dr. Wright, aye. Motion passed 
unanimously. 


2, 15-22: In Re: Carla Smith, D.V.M. Board may review, discuss, and take action on request 
to reconsider violation (A.R.S. §32-2233(B)(3) as it relates to A.A.C, R3-11-502(L)(6)) as stated 
in Consent Agreement offered. 
Attorney, David Stoll, on behalf of Respondent, was present to monitor and made 
statements. After discussion and consideration, a motion was made by Dr. Hatfield and 
seconded by Dr. Wright fo amend the language in Dr. Smith's Consent Agreement (and re- 
offer ihe amended Consent Agreement) with respect to A.R.S. §32-2233(B}(3} as it relates to 
A.A.C, R3-11-502(L) (6): be 
A.RS. §32-2233(B)(3) as it relates to A.A.C, R3-11-502(L)(6} failure to accurately 
document the number of teeth extracted throughout the animal's medical record. 
Motion passed unanimously. 


3. 14-27: In Re: Monica Bunge, D.V.M. Board appearance as required by Consent 
Agreement. Board may review, discuss, and take action on compliance with Second 
Amended Consent Agreement to determine if modifications to the terms and conditions of 
the probation are necessary.

Dr. Bunge was present, made statements, and answered questions. After discussion and 
consideration a motion was made by Ms. Mumford and seconded by Ms. Young to offer Dr. 
Bunge a new Consent Agreement to include the following terms and conditions: 

e A period of Probation for three years, 6 months, (3.5 years); 
Quarterly reports from behavioral health care providers; 
Quarterly Board appearances; 
Limited fo a 32 hours work week; 
Supervision by an Arizona licensed veterinarian unless working at a vaccination and 
wellness clinic; 

e Dr. Bunge is not to be a responsible veterinarian; and 

e Dr, Bunge ‘is to abstain from alcohol and non-prescribed medications. 
All other requirements in previous Consent Agreements will remain in effect as well.

Mumford, aye; and Dr. Wright, aye. Motion passed unanimously. 


4. 14-85: In Re: Mark Soderstrom, D.V.M. Board may review, discuss, and take action on 
compliance with Consent Agreement and Continuing Education plan submitted as required 
by the Consent Agreement In this case. 

After discussion and consideration, a motion was made by Dr. Haifield and seconded by 
Ms. Young to open an investigation with respect to Dr. Soderstrom’s non-compliance of his 
Board Order. Motion passed 5 ayes, ] absent (Dr. Wright}. 


5. 14-76: In Re: Mario Tascon, D.V.M. Board may review, discuss, and take action on 
remaining Continuing Education plan credits as required by Board Order. 

After discussion and consideration, a motion was made by Ms. Mumford and seconded by 
Dr. Christensen to approve one (1) of the two (2) hours of CE required in renal failure that Dr. 
Tascon plans on attending in compliance with his Board Order. Motion passed 5 ayes, 1 
absent (Dr. Wright). 


After further discussion and consideration, a motion was made by Ms. Mumford and 
seconded by Dr. Hatfield to approve one {1) hour of CE in IV fluid therapy that Dr. Tascon 
had proposed, in lieu of the remaining one (1) hour in renal failure, in compliance with his 
Board Order. Motion passed, 5 ayes, | absent (Dr. Wright). 


6. 14-41: In Re: Calvin Cordell, D.V.M. Board may review, discuss, and take action on 
additional information submitted regarding Continuing Education completed for license 
renewal and license status. 

After discussion and consideration, a motion was made by Dr. Christensen and seconded 
by Ms. Mumford to approve Dr. Cordell’s CE completed for license renewal. Motion passed 
unanimously. 


V. REPORTS, CORRESPONDENCE, REFERRALS AND OTHER BUSINESS 


1. Board may review, discuss, and take action on request for Temporary Permit pending 
submission of proof of graduation and affidavit from applicant.

Affer discussion and consideration, a motion was made by Ms. Mumford and seconded 
by Dr. Wright to approve Ms. Safnuk’s request for Temporary Permit pending submission 
of proof of graduation and affidavit from applicant. Motion passed unanimously. 


2. Board may review, discuss, and take action on veterinary application. 


a. Tiffany Johnson (R) 

After discussion and consideration, a motion was made by Dr. Wright and seconded by 
Ms. Mumford to approve Ms. Johnson's veterinary application and request her to 
appear before the Board, in person or telephonically. Motion passed unanimously. 


b. MaryAnn Radlinsky (E) 

After discussion and consideration, a motion was made by Dr. Christensen and 
seconded by Dr. Wright to approve Ms. Radlinsky’s veterinary application. Motion 
passed unanimously. 


3. Board may review, discuss, and take action on Change of Scope request for R2032, Santa 
Cruz Veterinary Clinic. 

Dr. Karter Neal was present telephonically, made statements, and answered questions. 
Based on the information received, the Board took no action on the Change of Scope 
request for R2032, Santa Cruz Veterinary Clinic. 


4.Board may review, discuss and take action on Celeste Kelly v. Victoria Whitmore, et. al., 
Maricopa County Superior Court Case No. CV2014-091906. 

Ms. Whitmore advised the Board for the need for an expert witness for the lawsuit and the 
associated costs. A special request for additional FY16 funding will be coordinated with the 
Governor's budget office. 


5.Board may review, discuss, and take action on reported charges from Dr. Rhonda Casper, 
After discussion and consideration, a motion was made by Ms. Mumford and seconded by 
Dr. Wright to direct Board staff to advise Board when Dr. Casper’s issue has been resolved, 
Motion passed unanimously. 


6.Board may review, discuss, and take action on premise license application for R2464: 
Catalina Animal Hospital. New Owner. Neil Farrington, DVM. 

After discussion and consideration, a motion was made that Dr. Mumford and seconded by 
Dr. Wright to approve premise license application for R2464: Catalina Animal Hospital. 
Motion passed unanimously. 


7.Board may review, discuss, and take action on American Association of Veterinary State 
Boards (AAVSB) Call for Nominations. 
No action taken. 


8.Board may review, discuss, and take action on denial of certification for Certified 
Veterinary Technician applicants who failed the VINE and/or State exam. List available 
upon request. 

After discussion and consideration, a motion was made by Ms. Mumford and seconded by 
Ms. Young to deny the CVT applicants who failed the VINE and/or State exam and 
authorize Ms. Whitmore to represent the Board if a settlement conference is requested with

her authority limited to denial. Motion passed unanimously. 


9. Board may review, discuss, and take action on approval of veterinary license pending

b. Investigative Committee opening 
The AM Investigative Committee still has a vacancy for a public member. A notice was 
placed on the Boara’s website in March. 


c. New Board member update 
As of this week, the Governor's office is still reviewing applicants. 


d. Financial update 
Ms. Whitmore updated the Board with the agency's financial information as of the end 
of the 39 quarter. Expenses and revenues are on track as projected. 


e. May Board meeting date 
May Board meeting will be on the second Wednesday of the month - May 13,

Ms. Whitmore advised the Board that Paws Plus has notified the Board that they may have 
a change in responsible veterinarian soon, which means they will need to reapply and that 
these premises will require re-inspection within 90 days of the applications’ receipt. The

repeated inspection of these shori-term clinics spread state-wide continues to place a 
strain on Board resources; the application fee ($100 in odd-numbered years) only pays a 
small portion of the actual cost of inspection for sites outside of the Phoenix-Metro area. 


After discussion and consideration, a motion was made by Ms. Mumford and seconded by 
Mr. Loughead to approve R2432, R2438, R2442, R2443, R2446, R2449 and R2462 pending 
inspection and compliance. Motion passed unanimously. 


After further discussion and consideration, a motion was made by Ms, Mumford and
